GDPR – General Information Clause

Fulfilling the duty of a personal data controller pursuant to the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) of 27 April 2016 (Official Journal of the EU L 2016 No. 119 p. 1), we inform that:

1. Personal data controller

The controller of your personal data is Zakład Mechaniczny SKRAW-MECH sp. z o.o. with registered office in Bydgoszcz, at ul. Zygmunta Augusta 11, post code: 85-082, entered into the commercial register of the National Court Register kept by the District Court in Bydgoszcz, 13th Commercial Division of the National Court Register, under KRS number 0000063484, NIP (Tax Identification Number) 967-10-31-216, REGON (Polish National Business Registry Number) 092429639, share capital in the amount of PLN 1,000,000.00, paid in full, hereinafter referred to as the Controller.

2. Purposes and grounds for the processing

The personal data will be processed by the Controller for the following purposes:

  1. for the purpose of entering into or performance of contracts or conducting other business relations (including order processing, execution of deliveries or payments, handling of complaints), for the purpose of preparing enquiries for proposals and responding to them; (under Article 6(1)(b) of the GDPR).
  2. for analytical purposes [better selection of services for the needs of our clients, general optimisation of service processes, development of knowledge on our clients, financial analysis of our company, etc.], which constitutes the pursue of legitimate interests (under Article 6(1)(f) of the GDPR).
  3. for archiving (evidential) purposes, which constitutes the pursuit of our legitimate interest consisting in securing information in case of a legal requirement to prove the facts (Article 6(1)(f) of the GDPR)
  4. for the potential establishment, exercise or defence against legal claims, which constitutes the pursuit of our legitimate interest (under Article 6(1)(f) of the GDPR)
  5. for the purposes of surveying the satisfaction of the clients, which constitutes the pursuit of our legitimate interest to determine the quality of our services and the level of satisfaction of our clients, related to products and services (under Article 6(1)(f) of the GDPR)
  6. for the purposes of providing IT security and IT processes (under Article 6(1)(f) of the GDPR).

3. Legal basis and the right to object

The legal basis for personal data processing are the provisions regulating the rules of personal data processing, including personal data processing using means of distance communication, and from 25 May 2018 the provisions of the GDPR. You have the right to object to the processing of the aforementioned data at any time. We will cease to process your data for the aforementioned purposes, unless we are able to prove that in relation to your data there are legitimate grounds for us which override your interests, rights, freedoms or that your data is necessary for the potential establishment, exercise or defence of legal claims.

4. Data recipients

The recipients of your personal data will only include the authorised employees of Zakład Mechaniczny SKRAW – MECH Sp. z o.o., provided that this is included in their official duties. The company can engage third parties to provide particular services (e.g. IT services, accounting services). Furthermore, we can engage others, including legal advisers, management consultants and auditors. Third parties provide their services to us and under our control and management, and they can have access to personal data within the scope required for the provision of such services.

5. Data retention period

Period for which the personal data will be stored:

  1. personal data processed for the purpose of entering into or performance of a contract and pursue of a legitimate interest of the Controller will be stored for the duration of the contract, and after it passes for a period necessary for:
    a. post-sale customer service (e.g. complaint handling)
    b. securing or exercising potential claims that the Controller is entitled to
    c. pursuing a legitimate interest of the Controller (e.g. pursuant to tax or accounting regulations);
  2. personal data processed for the purposes of product marketing or own services of the Controller on the basis of legitimate interest will be processed until the data subject raises an objection;
  3. personal data processed on the basis of a separate consent will be stored until that consent is withdrawn, whereas the Controller will be entitled to process the personal data regardless of the consent being withdrawn if the processing for this purpose is legitimate on a legal basis other than the consent.

6. Data subjects:

Your rights in relation to the processing of personal data by the Controller:

  1. the right of access to the content of your personal data and the right to obtain their copy;
  2. the right to rectification (amendment) of the data if the data processed by the Controller is incorrect or incomplete;
  3. the right to obtain from the Controller the erasure of data;
  4. the right to obtain from the Controller the restriction of data processing;
  5. the right to data portability, i.e. the right to receive the personal data provided to the Controller and to transmit them to another controller;
  6. the right to object to data processing on the basis of legitimate interest of the Controller or to processing for the purposes of direct marketing;
  7. the right to lodge a complaint with a Polish supervisory authority or a supervisory authority of another Member State of the European Union, competent due to the data subject's habitual residence, place of work or place of the alleged infringement of the GDPR;
  8. the right to withdraw the consent at any time (without affecting the lawfulness of processing based on the consent before its withdrawal). 

We will cease to process your data for the aforementioned purposes on the basis of your request, unless we are able to prove that in relation to your data there are legitimate grounds for us, which override your interests, rights, freedoms or that your data are necessary for the potential establishment, exercise or defence of legal claims.

 

7. Information on the requirement / voluntary nature of providing data
